§ 1. General provisions

The terms used in the Policy mean..: Shop: Internet Shop www.ketooftheyear.com; User: an entity using the publicly available Shop; Owner: NEW HANDEL SP Z O O, ul. Wałbrzyska 11/253A, 02-739 Warsaw; Cookies: text files sent by the Shop and saved on the User’s terminal device, which the User uses when browsing the website. Files contain information necessary for the proper functioning of the Store. Cookies most often contain the domain name of the Internet Shop from which they come, the time of their storage on the terminal device and number; the purpose of the Policy is in particular: to provide Users with information on the use of Cookies in the Shop, required by law, including the Telecommunications Law; to provide Users with privacy protection to the extent consistent with the standards and requirements set out in applicable laws. The Owner limits the collection and use of information concerning Users to the necessary minimum, required to provide services to them. In order to obtain full access through the Shop to the content and services offered by the Owner, it is advisable to accept the rules resulting from the Policy. The following provisions of law shall apply, among others: the Act of 16 July 2004 – Telecommunications Law (Journal of Laws 2017.1907, as amended); the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2017.1219, as amended); Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (general data protection regulation) (OJ L 119, 4.5.2016) together with the Polish provisions on the protection of personal data.

§ 2. Privacy and personal data protection

Data concerning Users are processed by the Owner in accordance with the law. Personal data of Users obtained by the Owner are processed on the basis of the consent granted by the User or on the basis of any other prerequisite entitling the User to process the data in accordance with the regulations, in particular the Regulation. The Owner shall take special care to protect the interests of the data subjects, and in particular shall ensure that the data is accurate: processed in accordance with the law, reliably and in a transparent manner for customers and other persons whose data they concern; collected for specific, clear and legally justified purposes and not further processed in a manner inconsistent with those purposes; adequate, appropriate and limited to what is necessary for the purposes in which they are processed; correct and, if necessary, updated; stored in a form enabling identification of the person to whom the data refer, for no longer than it is necessary for the purposes in which the data are processed; The Proprietor shall apply appropriate technical and organizational measures to ensure the protection of personal data processed, appropriate to the nature, scope, context and purposes of the processing and the risk of violation of rights or freedoms of natural persons. The Owner strives to systematically modernize the applied IT, technical and organizational measures for the protection of such data, in particular the Owner provides updates of IT protection measures allowing for protection against viruses, unauthorized access and other threats, arising from the functioning of the IT system and telecommunications networks. Each User, who in any way made his or her data available to the Owner, provides access to the data and exercise other rights to persons to whom the data relate, in accordance with the applicable provisions of law, including those persons have: the right to withdraw consent to the processing of personal data; the right to information concerning their personal data; the right to control the processing of data, including their supplementing, updating, rectifying, deleting; the right to object to the processing or to limit the processing; the right to complain to the supervisory authority and use other legal remedies to protect their rights. The owner may process personal data in an automated manner, including through profiling, in accordance with the principles set out in the Regulation. In such a case, the purpose of the Owner’s actions are marketing objectives or the need to personalize messages sent to Users (including matching information to the needs or expectations of the User). The User has the right to object to such processing of his/her data – this objection may be expressed by sending a message to the Owner’s address: shop@ketooftheyear.com. A person having access to personal data processes them only on the basis of the Owner’s authorization or contract of entrusting the personal data processing and only on the Owner’s order.

§ 3. Cookies

Cookies identify you and allow you to tailor the content of the website you are using to your needs. By remembering your preferences, it enables you to adjust the content, including advertisements, directed to you. The Owner uses Cookies to guarantee a reasonable standard of convenience for the Shop, and the data collected is used only within the company to optimize its operations. Cookies are used to: adjust the content of the Store to the preferences of the User; optimize the use of the Store, in particular by recognizing the User’s end device, create statistics, maintain the User’s session, provide the User with advertising content. Cookies may be placed in the Store User’s terminal equipment. The collected data is used to monitor and verify how Users use the Store to improve the functioning of the Store, ensuring more efficient and trouble-free navigation. Please note that in some cases, regardless of the Owner, the software installed by the User on the terminal device used to browse the web pages (e.g. web browser) introduces the default storage of cookies in the terminal device of the User. Users can change their settings for cookies at any time. These settings can be changed, among other things, in such a way as to block the automatic setting of Cookies or to notify the User of each time they are placed on the User’s terminal equipment. Detailed information on this can be found in the settings and instructions for the software (web browser). The User has the possibility to disable or restore the option of collecting cookies at any time by changing the settings in the Internet browser. Changing the settings is an expression of objection, which in the future may cause difficulties in using the Store. If you disable the Cookie option altogether, you will not be able to view the content of the Store except where access requires you to log in. If you do not change your settings, your data will be stored on your terminal device (using the Store will automatically place cookies on your terminal device). The stored data stored in the User’s terminal equipment does not cause any configuration changes in the User’s terminal equipment or software installed in that equipment. The information on Cookies also applies to other similar technologies used in the Shop.

§ 4. Final decisions

The policy was adopted by virtue of a regulation of the Owner and enters into force on 24.05.2018. Change of the Policy content may take place in the same mode. Any deviations from the Policy shall be made in writing under pain of nullity. The law applicable to the Policy is the law of the Republic of Poland. In matters not regulated in the Privacy Policy, relevant provisions of law shall apply.
